City restaurant to pay $567K for labor violations

PROVIDENCE – An investigation by the U.S. Department of Labor’s Wage and Hour Division found that Jacky’s Waterplace & Sushi Bar and its owner violated the minimum wage, overtime and recordkeeping requirements of the Fair Labor Standards Act. They will pay $567,000 in back wages and damages to 104 employees who were denied minimum wage and overtime pay.

The investigation found multiple instances in which servers, bartenders, cooks, bussers and dishwashers were paid less than the federal minimum wage, according to a Sept. 26 press release.

Employees at the 200 Exchange St. restaurant, owned by Kin Wah Ko, did not receive overtime pay if they worked more than 40 hours in a workweek, and workers were required to pay for breakages, customer walkouts and ordering errors out of their tips. Employees were also required to work without pay at charity events.

The restaurant and Ko must also pay $50,000 in civil penalties to the Labor Department. •
