DEM issues notice to firm constructing E.P. recycling plant

PROVIDENCE – The R.I. Department of Environmental Management said it has issued notice of its intent to suspend the construction and demolition debris-processing facility license for a recycling facility in East Providence.
The license was issues in May for TLA-Providence LLC to operate the TLA Pond View processing facility at One Dexter Road. DEM issued the notice to TLA due to recent amendments to the state’s Refuse Disposal Act. In a statement, DEM said it issued a letter to TLA on July 26 indicating that the new provisions applied to facilities such as the one owned by TLA and requesting that TLA provide the requisite “letter of compliance” no later than Oct. 31. To date, TLA has failed to do so, DEM said.
If TLA does not comply with the provision by Jan, 4, 2012, DEM said it will institute appropriate legal action to suspend the license.
According to DEM, East Providence issued a notice of violation to TLA on May 27 for alleged zoning-ordinance violations. TLA appealed the zoning violation to the city’s Zoning Board of Review, and following three days of hearings the board unanimously affirmed the zoning officer’s findings of violations at its Oct. 19 meeting. &#8226
