Mass. judge dismisses sick-time challenge

A Massachusetts judge has upheld the state’s earned sick-time law, which allows workers at all employers to earn up to 40 hours paid or unpaid sick time for every year worked, Boston Business Journal reported last week.

Passed by 60 percent of voters by ballot last fall and enacted by the state’s attorney general, the law was challenged by two construction contractors and six construction-employer associations.

According to the newspaper, the groups argued the sick-time law would disrupt existing contract arrangements with employees, and is pre-empted by federal labor law.

The law allows for employers with 11 or more employees to provide paid earned sick time to their employees. Companies with 10 or fewer employees must provide unpaid earned sick time.

U.S. District of Massachusetts Judge Rya Zobel dismissed the claim last week. Zobel said federal law and the state’s law can coexist.
