North Kingstown Retirement Community Proposal Wins Court Battle

North Kingstown, RI – May 29, 2015 – The Rhode Island Superior Court ruled this week that The Preserve at Rolling Greens can proceed with its planned retirement community development near the Route 102/Route 2 intersection in North Kingstown.  The ruling comes after years of opposition from residents of nearby neighborhoods who have been fighting the project in court.

The new community will be the first age-restricted retirement development in the town (other than subsidized housing projects).  The plan includes 86 units of housing, ranging from small efficiency and one-bedroom models to larger 3 bedroom houses. 

The project also includes a small-scale village with convenience shopping for residents and the nearby community.   The plan that was approved by the planning commission and town council limits the retail village to 40,000 sq ft.  In addition, there are 90 acres of land set aside to remain open space which cannot be developed.

The plan has been contested by residents of developments near the proposed community.  After initially spending four years meeting the requirements of the town Planning Commission and Town Council, the project’s developer met all the requirements for water preservation and land use.  An additional 1.5 years were consumed while the opposing residents took the battle to the courts.   Concerns about traffic and preservation of the rural character of western North Kingstown were driving the court challenges.  At one point, the two sides submitted petitions to the town council resulting in over 1,400 signatures supporting the project and fewer than 100 opposing.

Due to its designation as a retirement community, residents who live at The Preserve at Rolling Greens will add much-needed revenue to the tax base and have virtually no impact on the schools. Not only will this new community add much-needed revenue to our tax base, this increase will come with virtually no additional burden on town services. A 55+ community gives our town all the benefits of property taxes on high-value homes with no corresponding costs of additional children in the school system.
