Kilmartin joins coalition threatening to sue EPA over landfill methane regulation

PROVIDENCE – Rhode Island is among seven states threatening to sue the Environmental Protection Agency for its failure to enforce landfill methane regulation as part of the Clean Air Act, Attorney General Peter F. Kilmartin announced March 23.

Known formally as the 2016 Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills, the regulation “reduces emissions of volatile organic compounds, hazardous air pollutants, carbon dioxide and methane,” according to a news release.

Although the regulation went into effect Oct. 28, 2016, EPA has not enforced it, instead stating it “intends to complete a reconsideration of the regulation” by spring 2020.

California, Illinois, Maryland, New Mexico, Oregon and Vermont joined the Ocean State in submitting a 60-Day Notice of Intent to Sue.
