PROVIDENCE – A nursing assistant training program’s application for an ownership change is on probation after the R.I. Department of Health found several violations of state law during site visits. Your Choice of Training Program LLC has been a licensed program since May 2023. The program was owned by Jose Nunez and managed and operated by Evelyn Pinto De Duran, who applied to become the licensed owner. RIDOH documents show it requested more documents with De Duran’s application and conducted an unannounced site visit on March 20. RIDOH also conducted an announced visit on April 4. During the visits, RIDOH investigators found the program was in violation of state law. It wasn’t able to produce clinical logs and other educational documents for students in prior graduating class and there were many documents without dates or signatures. Also, the clinical facilities part of the program’s clinical training weren’t able to verify that all the students were there or that they had completed the required hours of clinical training. The program used two different clinical training facilities, but neither was approved by RIDOH as required and there were no clinical contracts in place. The program wasn’t able to show any student documents showing the English proficiency evaluation that is required. RIDOH found that classes were taught mainly in Spanish, as shown by the textbooks students were using. Also, students from the prior graduating class contacted by RIDOH were unable to communicate orr answer questions about their clinical training in English. As a result of these violations, RIDOH granted the program a two-year probationary period license. Under the probation, morning and afternoon classes must be limited to 30 students per section and there will be no weekend classes allowed. All students with English as a second language must pass an independent English proficiency entrance exam. No clinical hours can begin before week four of the program and all clinical training must be done in a pre approved skilled nursing facility. RIDOH must also get a list of all clinical groupings including who is in the group as well as where and when they will be completing their clinical hours at least seven days before each session. Your Choice must keep individual educational files for each student for at least two years after they’ve completed the program. The program can’t enroll any students whose tuition is paid for by the State of Rhode Island and must provide RIDOH quarterly reports on students who graduated the program and are employed by a home care provider owned or managed by De Duran. After the two year probation, Your Choice can apply for the license status to be changed to ‘Active.’ If Your Choice violates the probation RIDOH may revoke its license.
