PROVIDENCE – A 19-count federal indictment filed in U.S. District Court charges Jerrold N. Rosenberg, 62, of North Providence, with health care fraud, conspiracy to solicit or accept kickbacks, and receipt of kickbacks related to the prescription of the opioid Fentanyl, an under-the-tongue spray used to treat cancer pain, U.S. Attorney Peter F. Neronha announced Feb. 2.
It is alleged Rosenberg repeatedly submitted false and fraudulent documentation to insurers to get them to approve and pay for the spray, including authorization forms and so-called letters of medical necessity that falsely claimed patients had cancer and related pain.

It is also alleged Rosenberg conspired to seek and receive kickbacks from the Fentanyl manufacturer in the form of “sham” speaker programs, where he received company-paid dinners instead of lecturing on Fentanyl. It is alleged the speaker programs were a cover for payments by the drug company to induce Rosenberg to write more prescriptions. •
