Rep. Carter to file legislation
for separation of powers

PROVIDENCE — Rep. Kenneth Carter, a Democrat representing the parts of North Kingstown, South Kingstown and Exeter, has announced that he plans to pre-file a bill for the upcoming legislative session that would put a question on the ballot in 2004 asking voters to approve a constitutional amendment to establish separation of powers.

The amendment would change Article V of Rhode Island’s constitution to specify that none of the state’s three branches of government – executive, legislative, and judicial – shall exercise any power assigned to another branch. The amended article would also say, “These departments shall be separate and co-equal to the end it may be a government of laws and not men.”

The amendment to be placed before voters at the 2004 General Election would be binding, unlike the non-binding question that appeared on the state’s most recent ballot.
