CVS settles lawsuit with 18 states over billing

CVS Corp., the second largest U.S. drug store chain, on Thursday said it had reached a settlement with some states regarding billing practices known as partial-fill prescriptions.

CVS has agreed to pay $1.1 million. The amount will be divided among 18 states and the District of Columbia.

A partial-fill prescription is when a pharmacy does not have the full amount of the requested medication on hand and dispenses only enough of the medication to the customer to cover a portion of the prescription.

Prior to changes in procedures, CVS said, occasionally a customer may have failed to return for the remainder of the prescription, resulting in a possible billing error.

“Any isolated instances of incorrect billing for partially filled prescriptions were inadvertent,” Todd Andrews, director of corporate communications at CVS, was quoted in a release.
