Erik Realty ordered to clean Scituate property

SCITUATE, R.I. — At the request of Attorney General Sheldon Whitehouse, Superior Court Associate Justice Frank J. Williams ordered the removal of a pile of about 40,000 used automobile tires on Old Hope Kent Road in Scituate. Whitehouse sought an order demanding the tires be removed promptly, citing the potential threat to public health, the Scituate Reservoir, the state’s largest drinking water supply, and to the environment.

According to a press release, Whitehouse filed suit against the landowner, Erik Realty, in November 2000 after receiving a complaint from a neighbor about an alleged public nuisance.

According to the Superior Court Order, Erik Realty Inc. is to begin removing the tires from the property by January 1, 2001. In addition, the defendant must document, on a monthly basis, the progress of removal, with one-third of the tires removed by March 30, two-thirds by June 30, and the remaining tires removed by September 30. According to the Attorney General’s office, the tires are stored about 1,200 feet from the reservoir and were located on the property at the time the present owner acquired the land in May 2000.
